ARGOLD reserves the right to adapt or modify these terms and conditions at any time, the version of the general terms and conditions of sale applicable to any transaction being the one appearing online on the www.argold.fr website at the time of the order.

I- The Customer

The Customer declares that he is a natural or legal person and that he has the legal capacity to place an order on the site.

When registering the Client’s personal data in the “my account” section, the Client must ensure the accuracy and completeness of the mandatory data he/she provides. In case of error in the wording of the recipient’s coordinates, the ARGOLD Company cannot be held responsible for the impossibility of delivering the product. The ARGOLD Company reserves the right to cancel any order when the Customer’s IP address is domiciled in a country different from the billing and/or delivery address.

II- The Products

The products offered for sale are those described on the Site. The ARGOLD Company takes the greatest care in the presentation and description of these products to best satisfy the Customer’s information. It is however possible that non-substantial errors may appear on the Website, which the Customer acknowledges and accepts. The photographs and other visuals presented on the site are non-contractual. They have a simple informative value and do not engage the responsibility of the ARGOLD Company. In any case, in case of non-conformity of the delivered product compared to its description on the Site, the Customer will be able to exercise his right of retraction or to implement the legal guarantee of conformity. The ARGOLD Company will proceed, if necessary, to the reimbursement of all or part of the invoiced price, upon receipt of the item at the return address provided by the ARGOLD Company.

III- The Order

Ordering on the Site is subject to the respect of the procedure set up by the ARGOLD Company, concretised by a succession of different steps that the Customer must imperatively follow to validate his order. The Client will have the possibility, before definitively validating his/her order, to check the details of the order and its total price, and to correct any errors, before confirming it to express his/her acceptance. Any order confirmed by the Customer is considered as a sales contract and acceptance of all the stipulations of the present contract.

The ARGOLD Company may refuse any order from a Customer with whom there is a dispute or incident relating to the payment of a previous order or who contravenes the provisions hereof.

In this case, ARGOLD will inform the Customer by email. If the Customer fails to proceed with the correction of the erroneous elements or contrary to the present General Terms and Conditions of Sale, the ARGOLD Company reserves the right not to process the order.

A confirmation email summarising the order (products, price, quantity…) will be sent to the Customer by the ARGOLD Company. To this end, the Client formally accepts the use of electronic mail for the confirmation by ARGOLD of the content of its order. In any case, the invoices will be available for download in the Client’s area.

In the event of total or partial unavailability of the ordered products after placing the order, the Customer will be informed by e-mail of the delivery of a partial order, of an extension of the usual delivery times or of the cancellation of his order.

In application of the provisions of article L 121-20-3 of the Consumer Code, in the event of the unavailability of the product ordered, the Customer has the option of

Either to be delivered a product of equivalent quality and price, within the limits of available stocks;

Or to be reimbursed for the price of the product or service ordered within 30 days of his request.

The ARGOLD Company reserves the right to offer pre-sales on items that are not yet in stock. In this case, the indicative times of availability of the articles for their forwarding are specified in the article card.

1 - Determination of the price

The prices of the products are indicated in euros, including all taxes but excluding shipping costs. The total price of the order (including all taxes and shipping costs) is indicated on the order summary page which precedes the payment page.

For deliveries outside the French territory, the provisions of the General Tax Code relating to VAT will apply. Customs duties and other taxes applicable in the country of destination of the order must be paid by the Customer directly to the carrier.

ARGOLD reserves the right to modify its prices at any time, but the products will be invoiced on the basis of the prices in force at the time the order is registered, subject to availability.

2 - Terms of payment

The products are payable in cash on the day of the order.

The payment of purchases is made via the secure platform of the CAISSE D’EPARGNE by means of a payment card. The payment cards accepted to date are : Carte Bleue, Visa, MasterCard, American Express. In this respect, the Client expressly acknowledges that the communication of his/her bank card number via the payment platform made available by the ARGOLD Company is equivalent to authorising the debiting of his/her account up to the total amount of his/her order.

The ARGOLD Company reserves the right to remove or add new payment methods or to propose new payment methods on the Site at any time.

The Customer guarantees that he/she is fully entitled to use the payment card or his/her digital wallet for the payment of his/her order. The methods of debiting the Customer’s account are those governed by the banking establishment to which the payment card is linked.

The delivery means the physical transfer of the order to the recipient of the order, materialised by the physical possession of the Products by the recipient informed by the Customer during the order.

ARGOLD reserves the right to refuse certain orders from abroad for reasons of regulations or practical difficulties in transporting its products there. In this case, ARGOLD will inform the Customer by email within 5 days of the order and will refund the total amount of money received for this order within 5 days of sending this email.

Delivery is made to the delivery address indicated by the Customer, it being specified that this address must be the Customer’s home address or that of any other individual or legal entity of his/her choice domiciled in France (including DOM-TOM) or abroad. The delivery cannot be made to post office boxes.

The ARGOLD Company entrusts the routing and the delivery of the orders to the service of La Poste for the orders placed in France, or by other partners for the orders placed abroad. However, the ARGOLD Company reserves the possibility of using a carrier not specified in this list to ensure delivery of the order in similar conditions and as soon as possible.

In order for the indicative delivery times to be respected, the Customer must ensure that he/she has provided accurate and complete information concerning the delivery address (such as, in particular: street number, building number, staircase number, access codes, names and/or intercom numbers, etc.). The Customer may opt for the following delivery method :

1 - Standard delivery without commitment with indicative delivery times

This delivery method is charged 8€ by ARGOLD if chosen by the Customer. The standard delivery is carried out by the services of the Post Office. The delivery time depends on the destination address of your parcel or the delivery method chosen. For metropolitan France, it takes 3 to 5 days from the dispatch of your order for a home delivery and 3 days in a collection point. Any other indicative time can be consulted on the website of the Post Office.

The delivery times indicated by ARGOLD for standard delivery are generally observed.

2 - Delayed delivery

The ARGOLD Company cannot be held responsible for the consequences due to a delay in delivery which is not of its making. No reimbursement of the shipping costs will be made in case of delivery within a longer period than those indicated, for the absence of the addressee during the delivery by the carrier or for an absence of withdrawal by the addressee within the time limit in a parcel relay.

If the customer does not receive the package within 10 working days, he/she must alert the ARGOLD Customer Service at contact@argold.fr so that they can check with the carrier.

3 - Impossibility of delivery due to the Customer

With the agreement of ARGOLD, a re-shipment can be scheduled provided that the Customer pays a new delivery fee before any new shipment of the order. In the case of a standard delivery, the Customer no longer benefits from the free transport of the initial order.

4 - Delivery made

Each delivery is deemed to have been made as soon as the package is made available to the Customer, in particular by the carrier, as evidenced by the control system used by the carrier, such as the delivery tracking system offered on its website or on the delivery notice sent by email or SMS to the Customer. It is the Customer’s responsibility to check the shipments upon arrival and to make any reservations and claims that appear justified, or even to refuse the package if it is likely to have been opened or if it bears obvious traces of deterioration.
