General conditions

www.argold.fr (hereinafter referred to as "The Site") is published by ARGOLD, a simplified joint-stock company with a capital of 10,000 euros, whose registered office is at 9 Rue Tronchet, 69006 Lyon, registered with the RCS of LYON under number 832 327 753, intra-community VAT number FR 56832327753 (hereinafter referred to as "ARGOLD"). All orders placed on the www.argold.fr site are subject to these general terms and conditions of sale. ARGOLD reserves the right to adapt or modify these terms and conditions at any time, the version of the general terms and conditions of sale applicable to any transaction being that appearing online on the www.argold.fr site at the time of the order.

I- The Client

The Customer declares to be a natural or legal person and to have the legal capacity allowing him to place an order on the site.

When registering the Customer's personal data in the "my account" section, the latter must ensure the accuracy and completeness of the mandatory data that he provides. In the event of an error in the wording of the recipient's contact details, ARGOLD cannot be held responsible for the impossibility of delivering the product. ARGOLD reserves the right to cancel any order when the Customer's IP address is domiciled in a country different from the billing and/or delivery address.

II- The Products

The products offered for sale are those described on the Site. ARGOLD Company takes the greatest care in the presentation and description of these products to best satisfy the Customer's information. However, it is possible that non-substantial errors may appear on the Site, which the Customer acknowledges and accepts. The photographs and other visuals presented on the site are non-contractual. They have a simple informative value and cannot engage the responsibility of ARGOLD Company. In any event, in the event of non-conformity of the product delivered in relation to its description on the Site, the Customer may exercise his right of withdrawal or implement the legal guarantee of conformity. ARGOLD Company will proceed, where applicable, to the reimbursement of all or part of the invoiced price, upon receipt of the item at the return address provided by ARGOLD Company.

III- The Order

The taking of an order on the Site is subject to compliance with the procedure set up by the ARGOLD Company, embodied by a series of different steps that the Customer must follow to validate his order. The Customer will have the possibility, before definitively validating his order, to check the details of it and its total price, and to correct any errors, before confirming it to express his acceptance. Any order confirmed by the Customer constitutes a sales contract and acceptance of all the provisions hereof.

ARGOLD may refuse any order from a Customer with whom there is a dispute or incident relating to the payment of a previous order or which contravenes the provisions hereof.

In this case, ARGOLD will inform the Customer by email. If the Customer fails to correct any erroneous elements or those contrary to these General Terms and Conditions of Sale with ARGOLD, ARGOLD reserves the right not to process the order.

A confirmation email summarizing the order (products, price, quantity, etc.) will be sent to the Customer by ARGOLD. To this end, the Customer formally accepts the use of email for confirmation by ARGOLD of the content of his order. In any event, invoices will be available for download in his customer area.

In the event of total or partial unavailability of the products ordered after the order has been placed, the Customer will be informed by email of the delivery of a partial order, an extension of the usual delivery times or the cancellation of the order.

In application of the provisions of article L 121-20-3 of the Consumer Code, in the event of unavailability of the product ordered, the Customer then has the option:

Either to be delivered a product of equivalent quality and price, within the limit of available stocks;

Either to be reimbursed for the price of the product or service ordered within 30 days of the request.

ARGOLD reserves the right to offer pre-sales on items that are not yet in stock. In this case, the indicative deadlines for the availability of the items for shipment are specified in the item sheet.

IV- Prices and Payment Terms

1 – Determination of the price

Product prices are indicated in euros, all taxes included excluding shipping costs. The total price of the order (all taxes and shipping costs included) is indicated on the order summary page preceding the payment page.

For deliveries outside French territory, the provisions of the General Tax Code relating to VAT will apply. Customs fees and other taxes applicable in the country of destination of the order must be paid by the Customer directly to the carrier.

ARGOLD reserves the right to modify its prices at any time, but the products will be invoiced on the basis of the prices in effect at the time the order is registered, subject to availability.

2 – Payment method

The products are payable in cash on the day of the actual order.

Payment for purchases is made via the secure platform of CAISSE D'EPARGNE using a payment card. The payment cards currently accepted are: Carte Bleue, Visa, MasterCard, American Express. In this regard, the Customer expressly acknowledges that the communication of his bank card number via the payment platform made available by the ARGOLD Company constitutes authorization to debit his account up to the total amount of his order.

ARGOLD Company reserves the right to remove or add new means or propose new payment methods on the Site at any time.

The Customer guarantees that he is fully authorized to use the payment card or his digital wallet for the payment of his order. The terms of debiting the Customer's account are those governed by the banking establishment to which the payment card is attached.

3 – Recorded data

The data recorded and stored by ARGOLD Company constitutes proof of the order and all past transactions. The data recorded by the payment platform constitutes proof of financial transactions.

V- Delivery

Delivery means the physical transfer of the order to the recipient of the order, materialized by the physical possession of the Products by the recipient indicated by the Customer when ordering.

ARGOLD reserves the right to refuse certain orders from abroad for regulatory reasons or practical difficulties in shipping its products there. In this case, it will inform the Customer by email within 5 days of the order in question and will refund all sums received for this order within 5 days of sending this email.

Delivery is made to the delivery address indicated by the Customer, it being specified that this must be the residential address of the Customer or any other natural or legal person of their choice domiciled in France (including DOM-TOM) or abroad. Delivery cannot be made to PO boxes.

ARGOLD Company entrusts the routing and delivery of orders to the La Poste service for orders placed in France, or by other partners for orders placed abroad. However, ARGOLD Company reserves the right to occasionally use a carrier not specified in this list to ensure delivery of the order under similar conditions and as quickly as possible.

In order to meet the indicative delivery times, the Customer must ensure that they have provided accurate and complete information regarding the delivery address (such as, in particular: street number, building number, staircase number, access codes, names and/or intercom numbers, etc.). The Customer may opt for the following delivery method:

1 – Standard delivery without commitment with indicative delivery times

This delivery method is charged €8 by ARGOLD if chosen by the Customer. Standard delivery is carried out by the Post Office services. The delivery or availability time depends on the destination address of your package or the delivery method chosen. For mainland France, it takes 3 to 5 days from the dispatch of your order for home delivery and 3 days for a collection point. Any other indicative time frame can be consulted on the Post Office website.

The delivery times indicated by the ARGOLD company for standard delivery are generally observed.

2 – Delay in delivery

ARGOLD cannot be held responsible for the consequences due to a delay in delivery that is not its fault; no refund of shipping costs will be made in the event of delivery within a longer period than those indicated, for the absence of the recipient upon delivery by the carrier or for the absence of collection by the recipient within the time limit at the Parcel Relay.

If the customer does not receive their package within 10 working days, they must alert ARGOLD Customer Service at contact@argold.fr so that additional checks can be carried out with the carrier.

3 – Impossibility of delivery due to the Customer

In the event of impossibility of delivery due to an incorrect address, due to the absence of the recipient during the first delivery and possible other visits by the carrier, due to the absence of collection of the order at the selected collection point or from the Post Office in the event of absence at the address provided by the Customer, no reshipment may be required by the Customer. With the agreement of ARGOLD, a reshipment may be scheduled provided that the Customer pays new delivery costs before any new shipment of the order. In the case of a standard delivery, the Customer no longer benefits from free transport of the initial order.

4 – Delivery made

Each delivery is deemed to have been made upon the parcel being made available to the Customer, in particular by the carrier, as evidenced by the control system used by the carrier, such as the delivery tracking system offered on its website or on the delivery notice sent by email or SMS to the Customer. It is the Customer's responsibility to check the shipments upon arrival and to make any reservations and complaints that appear justified, or even to refuse the parcel, if it is likely to have been opened or if it shows obvious signs of deterioration. Said reservations and complaints must be sent to the carrier by registered letter with acknowledgment of receipt within three working days following delivery of the products, a copy will be immediately sent to ARGOLD.

VI - Right of withdrawal and reimbursement

You have 30 days from the receipt of our shipment to return, without giving a reason, any products ordered on the website www.argold.com. To make a return request, simply log in to your account and follow the online procedure.

To benefit from your right of withdrawal, the item must not have been worn or used, nor have been personalized, it must be packaged in its original packaging with its protective cover and labels. Shipping costs are the responsibility of the Customer and are not refunded.

Refunds for returned products will be made within a maximum of 10 days after receipt of said products. Refunds will only be made on the amount paid by the Customer for the items ordered and will not apply to the shipping costs paid by the Customer when ordering.

VII–Information Technology and Freedoms

The information collected by ARGOLD Company during a Customer order is necessary for the management of the transaction and for this purpose may be communicated in whole or in part to ARGOLD Company service providers involved in the execution of the order.

The Customer is informed that this same personal data may also be collected by an organization responsible for analyzing orders and combating bank card fraud.

In accordance with the Data Protection Act No. 78-17 of 6 January 1978, the Client has the right to access, rectify, oppose and delete data concerning him/her.

VIII – Host

The website www.argold.fr is hosted by Shopify - 151 O'Connor Street - Ottawa, Ontario K2P 2L8 CANADA . All variations of web addresses of argold.com, .fr, .org , as well as all other extensions, of which the ARGOLD Company is the owner or depositary, in general all Internet addresses (url) related to the ARGOLD brand and its associated brands are rerouted to the website www.argold.fr

The website www.argold.fr or access to one or more services within the site, in particular the online sales area, may, without notice or compensation, be closed temporarily or permanently, without an Internet user or a Customer being able to claim any compensation. In this case, orders recorded prior to closure will be processed according to the terms above.

IX- Applicable law

Any order automatically implies the Customer's acceptance of the general terms and conditions of sale. These general terms and conditions of sale are governed by French law. In the event of a dispute, only the French courts will have jurisdiction. In the event of a difficulty or complaint regarding an order, the Customer may contact Customer Service to find an amicable solution. In the absence of an amicable solution, the dispute will be brought exclusively before the Courts of Lyon.
